20 May 2024: Legal Overview on Tapera (Tabungan Perumahan Rakyat), the "Citizen's Saving for Housing"

On 20 May 2024, Indonesia promulgated the Government Regulation Number 21 Year 2024 on the Amendment of Government Regulation Number 25 Year 2020 on the Implementation of Citizen's Saving for Housing (Peraturan Pemerintah Nomor 21 Tahun 2024 tentang Perubahan atas Peraturan Pemerintah Nomor 25 Tahun 2020 tentang Penyelenggaraan Tabungan Perumahan Rakyat) , commonly called as the " Tapera " . Referring to its definition, in principle, Tapera is a saving, conducted periodically by the "Participant", that can be utilized only for financing the housing and/or can be returned along with its yield resulted after the one's participation is ended. As stipulated in Article 15 of the Tapera regulation, the "Saving" rate has been set at 3% (three percent) of the "Salary" or "Wage" towards the "Employee Participant" (0.5% by the Employer and 2.5% by the Employee), and of the "Income" towards the "Independent Worker...

Manpower Minister Regulation Number 2 Year 2022: "Old Day" Security, Pension Security, Unemployment Security (Indonesia: Jaminan Hari Tua (JHT), Jaminan Pensiun (JP), Jaminan Kehilangan Pekerjaan (JKP))

On 2 February 2022, the Manpower Ministry issued the Manpower Minister Regulation Number 2 Year 2022 concerning the "Old Day" Security (literally translated from Indonesian: Jaminan Hari Tua) ("Minister Regulation 2 / 2022") and will be effective after 3 month following its issuance.

Minister Regulation 2 / 2022 revoked the Manpower Minister Regulation Number 19 Year 2015 concerning the Procedure and Requirement for the Payment of "Old Day" Security Benefits (literally translated from Indonesian: Tata Cara dan Persyaratan Pembayaran Manfaat Jaminan Hari Tua) ("Minister Regulation 19 / 2015")

Minister Regulation 2 / 2022 stipulates that the benefits shall only be paid to the beneficiary (employee) upon reaching pension age of 56, in comparison with Minister Regulation 19 / 2015, the benefits may also be paid (at once) whenever the employee stopped working because of the reason stipulated in the regulation, includes, among others, upon resignation, and termination.   

Apart from Minister Regulation 19 / 2015, in 2015, the government enacted the Government Regulation Number 45 Year 2015 on Pension Security (Indonesian: Jaminan Pensiun).

Jaminan Pensiun adalah jaminan sosial yang bertujuan untuk mempertahankan derajat kehidupan yang layak bagi peserta dan/atau ahli warisnya dengan memberikan penghasilan setelah peserta memasuki usia pensiun, mengalami cacat total tetap, atau meninggal dunia.


Definisi Jaminan Kehilangan Pekerjaan

(berdasarkan Peraturan Pemerintah Nomor 37 Tahun 2021 tentang Penyelenggaraan Program Jaminan Kehilangan Pekerjaan)

Pasal 1 Ayat 1

Jaminan Kehilangan Pekerjaan yang selanjutnya disingkat JKP adalah jaminan sosial yang diberikan kepada Pekerja/Buruh yang mengalami Pemutusan Hubungan Kerja berupa manfaat uang tunai, akses informasi pasar kerja, dan Pelatihan Kerja.
