20 May 2024: Legal Overview on Tapera (Tabungan Perumahan Rakyat), the "Citizen's Saving for Housing"

On 20 May 2024, Indonesia promulgated the Government Regulation Number 21 Year 2024 on the Amendment of Government Regulation Number 25 Year 2020 on the Implementation of Citizen's Saving for Housing (Peraturan Pemerintah Nomor 21 Tahun 2024 tentang Perubahan atas Peraturan Pemerintah Nomor 25 Tahun 2020 tentang Penyelenggaraan Tabungan Perumahan Rakyat) , commonly called as the " Tapera " . Referring to its definition, in principle, Tapera is a saving, conducted periodically by the "Participant", that can be utilized only for financing the housing and/or can be returned along with its yield resulted after the one's participation is ended. As stipulated in Article 15 of the Tapera regulation, the "Saving" rate has been set at 3% (three percent) of the "Salary" or "Wage" towards the "Employee Participant" (0.5% by the Employer and 2.5% by the Employee), and of the "Income" towards the "Independent Worker...

22 September 2021: News on Minister of Trade Regulation: Importation of Used Capital Goods, in Not-New-Conditions

Indonesian government issued the Minister of Trade Regulation Number 53 Year 2021 (Peraturan Menteri Perdagangan Nomor 53 Tahun 2021) concerning the revocation of the Minister of Trade Regulation Number 44 Year 2021 on third amendment of the Minister of Trade Regulation Number 118 Year 2018 (Peraturan Menteri Perdagangan Nomor 118 Tahun 2018, “MTR 118/2018”) (“MTR 44/2021”) concerning the Importation of Capital Goods in Not-New-Conditions (Ketentuan Impor Barang Modal Dalam Keadaan Tidak Baru) on 13 September 2021 and enacted on 22 September 2021 (“MTR 53/2021”).

This MTR 53/2021 has 2 provisions which simply revoked MTR 44/2021 in Article 1, and the effectiveness (of revocation) in Article 2 upon enactment of this MTR 53/2021.

Recalling our memory that MTR 44/2021 regulated the third amendment of MTR 118/2018, one of its provisions has exempted certain Importation of Capital Goods in Not-New-Condition as stated in its Appendix VI.
