20 May 2024: Legal Overview on Tapera (Tabungan Perumahan Rakyat), the "Citizen's Saving for Housing"

On 20 May 2024, Indonesia promulgated the Government Regulation Number 21 Year 2024 on the Amendment of Government Regulation Number 25 Year 2020 on the Implementation of Citizen's Saving for Housing (Peraturan Pemerintah Nomor 21 Tahun 2024 tentang Perubahan atas Peraturan Pemerintah Nomor 25 Tahun 2020 tentang Penyelenggaraan Tabungan Perumahan Rakyat) , commonly called as the " Tapera " . Referring to its definition, in principle, Tapera is a saving, conducted periodically by the "Participant", that can be utilized only for financing the housing and/or can be returned along with its yield resulted after the one's participation is ended. As stipulated in Article 15 of the Tapera regulation, the "Saving" rate has been set at 3% (three percent) of the "Salary" or "Wage" towards the "Employee Participant" (0.5% by the Employer and 2.5% by the Employee), and of the "Income" towards the "Independent Worker...

Indonesian Language Provisions on IPTV (Internet Protocol Television)

Ministry Regulations concerning the Implementation of IPTV (Internet Protocol Television):
No clear provision to require “Bahasa Indonesia” (the subtitle & the likes) on IPTV content in Ministry of Communication & Informatics Regulation No.30/2009 which be revoked by No.11/2010 vide its amendment No.15/2014 of the Implementation of IPTV (“Ministry Regulations”), but to consider the provision which regulate:
  • for broadcasting (pushed services), the IPTV operator shall provide at minimum 10% of its channel capacity to broadcast local-production content*.
  • for multimedia (pulled services and interactive services), the IPTV operator shall provide local-production content* at minimum 30% of its content library/collection.
  • total of local Independent Content Provider** which contribute the IPTV implementation shall at minimum 10% among all content provider of IPTV operator, and shall be gradually increased at minimum 50% within 5 years.
*there is no definition on local-production content under those regulations, unregulated whether such local-production shall be in “Bahasa Indonesia” or not.
**local Independent Content Provider reflects for its (local) entity (vide its definition).

Government Regulation concerning the Broadcasting Implementation of Paid/Subscribed Broadcasting Services Institution
Such Ministry Regulation referring the relevant Government Regulation under its consideration's reference, which is Government Regulation No.52/2005 in relevant with the paid/subscribed broadcasting services (in this matter IPTV).
Under its Article 20 that the foreign language broadcasting-programme may be broadcasted in its native language, and especially for Paid/Subscribed Broadcasting Services Institution shall be provided with Bahasa Indonesia text or be selectively voiced-over into Bahasa Indonesia according to the purpose of certain programme.
If so failed to accomodate such provision, then Article 51 regulate the penalty to be imposed in the form of warning letter up to temporary suspension on such programme.
Furthermore, we can take a look at the Elucidation of such Article 20:
What is meant by "selectively voiced-over" is the voice-over only be intended for children and science programme. That this provision is preferred for the recording programme.
What is meant by "especially for Paid/Subscribed Broadcasting Services Institution shall be provided with Bahasa Indonesia text" is only for movie programme.

Broadcasting Law:
The related Law (Article 39 of Broadcasting Law No.32/2002 & Article 20 of Government Regulation No.52/2005) oblige for the foreign-language broadcasting services in Indonesia to require Bahasa Indonesia subtitle specifically / only for television broadcasting services (jasa penyiaran televisi), no definition on such Law, may further reflects to IPTV operator as one of the television broadcasting services (which consisting of public/free or paid/commercial services).
Besides, its Law's Article 20 stipulates the voice over from foreign language into Bahasa Indonesia be limited at the most 30% of total foreign language broadcasted programme(s).
Such Bahasa Indonesia obligation faced the law penalty in its Article 55 of such Law (and Article 51 on above Government Regulation).
